The FOMEMA Appeal Process allows employers and appointed panel agencies to appeal the medical status of foreign workers who have been certified as ‘Unsuitable’ due to certain diseases detected during the FOMEMA Foreign Workers Medical Examination, in accordance to the guidelines set by the Ministry of Health Malaysia (MoH).
As part of the appeal process, eligible foreign workers are required to undergo additional medical assessments and, where applicable, treatment at FOMEMA’s assigned Panel Clinics and/or Appeal Panel Hospitals. The outcome of these assessments will determine the foreign worker’s final medical status.
FOMEMA introduced the Appeal Process to ensure fair evaluation for foreign workers seeking employment. All applications are thoroughly reviewed, and eligible cases undergo additional tests or referral to a medical specialist.
For list of diseases not allowed for appeal, you may visit
www.fomema2u.com.my/employer-agency/appeal-procedure/
Employers and appointed Panel Agencies may submit an appeal on behalf of affected foreign workers via the FOMEMA Online Portal.
Employers or appointed Panel Agencies MUST bring the following documents when attending their foreign worker’s appeal process at FOMEMA’s appeal panel clinics or hospitals:
1. Original passport of the foreign worker
2. Payment Receipt
3. Appeal referral letter (if applicable)
If the foreign worker is certified as ‘Unsuitable’ but eligible for appeal, this will be stated in the medical examination results email notification sent to the Employer or Panel Agency.
Employers and appointed Panel Agency are advised to submit the appeal within the stipulated appeal period to avoid the appeal eligibility period expiring.
No. Submitting an appeal does not guarantee that the foreign worker will be certified as ‘Suitable’.
During the appeal process, the foreign worker will undergo additional medical assessment and, where applicable, a specialist assessment. The final appeal outcome will be determined based on the specialist’s clinical assessment and/or supporting laboratory results.
The appeal process takes 30 days from the date of appeal payment made.
You may refer to the FOMEMA Appeal Process procedures on the FOMEMA corporate website at
https://www.fomema2u.com.my/employer-agency/appealprocedure/
The Employer or appointed Panel Agency may initiate and register the appeal through the FOMEMA Online Portal. Once the registration has been reviewed and approved, the appeal payment must be made upfront via the portal before the next course of action.
Foreign workers diagnosed with syphilis are required to obtain a referral letter from the Panel Clinic. The employer must then make an appointment with the assigned Appeal Panel Hospital before the worker attends the hospital for a specialist assessment.
Yes. In line with the directive issued by the Ministry of Health Malaysia (MoH), appeals are now allowed for foreign workers certified as ‘Unsuitable’ due to Syphilis, effective 20 July 2026.
Employers and appointed panel agencies may submit an appeal on behalf of affected foreign workers via the FOMEMA Online Portal.
Log in to the FOMEMA Online Portal, submit the appeal application, and complete the required payment to FOMEMA. Upon successful registration and payment, an Appeal To-Do List will be generated in the portal.
The total appeal fee is RM1,350.00, comprising:
FOMEMA Appeal Fee: RM15.00
Panel Clinic Fee: RM35.00
Specialist Fee Deposit: RM1,020.00
CD Monitoring Programme: RM280.00
Total: RM1,350.00 (not including SST)
The RM1,350.00 is collected upfront based on the maximum applicable specialist fee. The final fee will depend on the specialist’s diagnosis and the scope of assessment and/or treatment required.
Yes. If the final specialist fee is lower than the deposit amount collected, the balance will be credited to the employer’s registered account within 14 calendar days from the date of the appeal decision.
Foreign workers diagnosed with Syphilis are required to obtain a referral letter from the Panel Clinic. The employer must then make an appointment with the assigned Appeal Panel Hospital before the worker attends the hospital for a specialist assessment.
A valid referral letter issued by the assigned Panel Clinic is mandatory for foreign workers diagnosed with Syphilis to proceed with a specialist assessment.
Treatment is required for certain categories of Syphilis, based on the specialist’s diagnosis, to prevent the spread of the infection. Early treatment helps manage the infection and prevent health complications.
Where treatment is required, the worker must complete the prescribed treatment and attend the follow-up assessments recommended by the specialist as part of the appeal process. The final appeal decision will be based on the specialist’s assessment and the worker’s compliance with the required treatment and monitoring.
Treatment and follow-up assessments are mandatory components of the Syphilis Appeal Process. If the worker refuses or fails to complete the required treatment within the stipulated period, the appeal will be deemed unsuccessful, and the worker’s original ‘Unsuitable’ status will remain unchanged.
Completing the required treatment does not automatically guarantee a successful appeal. The appeal outcome may be affected by the worker’s follow-up test results, response to treatment, specialist’s assessment, and compliance with the CD Monitoring Programme requirements.
There is no fixed likelihood or guarantee that the Syphilis test result will become non-reactive. The test outcome depends on factors such as the stage of infection, initial Venereal Disease Research Laboratory (VDRL) test level, response to treatment, completion of treatment, and possible reinfection.
Foreign workers granted conditional approval to continue working in Malaysia will be enrolled in the Communicable Disease (CD) Monitoring Programme, in accordance with the requirements of the Ministry of Health Malaysia (MoH).
